1. Eligibility
- Participation is open to individuals aged 18 years or older, residing in Australia.
- We accept solid gold jewellery of 9kt or higher (yellow, rose, or white) and platinum.
- We do not accept plated, filled, vermeil, or non-solid precious metals.
2. Enquiry & Submission
- Please start your request by completing the Gold Swap Form on our website or physically in-store, providing accurate contact details and a clear image of your items.
- Customers must agree to these Terms & Conditions before handing over items to be assessed.
- A Holding Agreement must be signed before items are accepted.
3. Holding Agreement
- Black Finch will hold submitted items for a maximum of 6 months from the date of receipt.
- During this period, Black Finch will make reasonable attempts to contact the customer. If the customer ceases communication, items will be returned via post to the address last provided.
- Return of Items: Where practicable, Black Finch will attempt to return the items to the customer’s last known address by tracked delivery. The customer will be responsible for any return postage or courier fees.
- Undeliverable Returns: If the items cannot be delivered (for example, due to incorrect address details, non-collection, or refusal of delivery), Black Finch will notify the customer and hold the items for a further 30 days.
- Final Disposal: After the additional 30-day period, if no arrangements are made, Black Finch reserves the right to treat the items as unclaimed goods under Victorian law and may dispose of or recycle them without further liability to the customer.
- Black Finch will not be responsible for any loss arising from unclaimed, refused, or undeliverable items once the holding and notice periods have lapsed.
4. Shipping & Insurance
- Where pre-paid shipping is provided by Black Finch, parcels will be sent via an insured and tracked Australia Post service.
- Black Finch arranges insurance coverage for items in transit up to a maximum value of AUD $5,000.
- Customers acknowledge that any loss or damage above this amount is at their own risk.
- Customers may choose to arrange their own delivery and insurance at their own cost.
5. Gemstones & Non-Gold Materials
- Precious Gemstones: Extraction can be attempted if requested, but Black Finch does not guarantee safe removal. Customers acknowledge that stones are likely to fracture, chip, or be damaged.
- Non-Precious Gemstones / Non-Gold Components: These will not be extracted and will be refined along with the gold.
- Customers wishing to retain gemstones and exchange gold for credit are encouraged to book in a consultation for an heirloom custom redesign.
6. Assessment & Valuation
- Gold items are tested for purity and weight.
- Customers will receive a credit offer and exchange agreement within 7 business days of Black Finch receiving their items.
- Offers are calculated based on the daily gold market rate, therefore credit offers remain valid for 7 days. After expiry, a new quote will be required.
7. Acceptance & Cooling-Off Period
- Once the Exchange Offer Agreement is signed and after a 7 day cooling off period has passed, items are deemed non-returnable.
- A 7-day cooling-off period applies after acceptance. During this time:
- Customers may withdraw their acceptance by written notice.
- If withdrawn, items will be returned to the customer by tracked delivery at their expense.
- After the cooling-off period, the items will be refined and cannot be reclaimed.
8. Store Credit
- Upon acceptance, customers receive a digital store credit valid for 3 years from the date of issue.
- Store credit may be redeemed online, in-store, or put toward a custom design service.
- Store credit is non-refundable and cannot be exchanged for cash.
9. Limitation of Liability
- Customers are responsible for ensuring items are packaged securely when shipping.
- Black Finch is not liable for loss or damage caused by third-party couriers beyond the insured amount specified in Section 4.
- To the fullest extent permitted by law, Black Finch’s liability is limited to the store credit value issued to the customer.
- If shipping gold to Black Finch Jewellery, customers are encouraged to retain records of their shipped items and follow the photo tips outlined on the Gold Swap Request form.
